These Terms of Service govern access to and use of EduOnTrack, LLC services, including DeviceOnTrack, ClassOnTrack, and educationontrack.com. By using the services, you agree to these Terms. If you use the services for a school, district, company, or other organization, you represent that you are authorized to accept these Terms on its behalf.
Services Covered
DeviceOnTrack provides tools for school device tracking and device management workflows. ClassOnTrack provides classroom focus session tools, join links or codes, and engagement-related features. Additional product-specific terms, order forms, school agreements, or data processing terms may also apply.
Accounts and Authorized Users
Users must provide accurate account information and keep login credentials secure. Schools and organizations are responsible for managing authorized users, assigning appropriate roles, and removing access when users no longer need it. You are responsible for activity under your account unless caused by our breach of these Terms.
School and Student Use
When a school or educator uses DeviceOnTrack or ClassOnTrack with students, the school is responsible for determining that the service is appropriate for its educational purpose and for providing notices or obtaining consents required by applicable law. EduOnTrack, LLC will use school-controlled student data to provide and support the services, as described in the Privacy Policy and any applicable school agreement.
Acceptable Use
You may not use the services to:
- Violate laws, regulations, contracts, or school policies.
- Upload or transmit malicious code, attempt unauthorized access, or interfere with service operation.
- Harass, threaten, exploit, or harm another person.
- Collect or disclose personal information without required authority or consent.
- Reverse engineer, scrape, copy, resell, or misuse the services except as allowed by law or written agreement.
- Use the services for surveillance, discipline, or high-stakes decisions in a way that violates law, school policy, or applicable agreements.
Customer Content and Data
Schools, districts, educators, and users may submit content or data to the services. You keep ownership of your content and grant EduOnTrack, LLC the limited rights needed to host, process, transmit, display, secure, and support that content as part of the services. You are responsible for having the rights and permissions needed to submit content to the services.
Service Changes and Availability
We may improve, modify, suspend, or discontinue features from time to time. We aim to provide reliable services, but we do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, network issues, security events, or force majeure events may affect availability.
Fees and Payment
Some services or features may require payment. Fees, billing terms, renewal terms, and cancellation terms may be described in an order form, checkout flow, invoice, or separate agreement. Unless stated otherwise, fees are non-refundable except where required by law or written agreement.
Intellectual Property
EduOnTrack, LLC and its licensors own the services, software, designs, trademarks, logos, and related intellectual property. These Terms do not transfer ownership of our intellectual property. You may use the services only as permitted by these Terms and applicable agreements.
Privacy
Our Privacy Policy explains how we collect, use, share, and protect information. By using the services, you acknowledge the Privacy Policy. Schools and organizations remain responsible for their own privacy notices, consents, and compliance obligations.
Third-Party Services
The services may integrate with or link to third-party services. EduOnTrack, LLC is not responsible for third-party services, content, policies, or practices. Your use of third-party services may be governed by separate terms.
Disclaimers
The services are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. EduOnTrack, LLC does not provide legal, compliance, academic, disciplinary, or professional advice through the services.
Limitation of Liability
To the fullest extent permitted by law, EduOnTrack, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for claims relating to the services will not exceed the amount paid to EduOnTrack, LLC for the applicable service in the twelve months before the claim, or one hundred dollars if no amounts were paid, unless applicable law requires otherwise.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless EduOnTrack, LLC from claims, damages, liabilities, and expenses arising from your misuse of the services, violation of these Terms, violation of law, or content you submit.
Suspension and Termination
We may suspend or terminate access if we believe a user has violated these Terms, created security risk, caused legal exposure, failed to pay required fees, or used the services in a way that may harm users, schools, or the services. Users may stop using the services at any time.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules, unless an applicable written agreement states otherwise or applicable law requires a different governing law.
Changes to These Terms
We may update these Terms from time to time. If changes are material, we may provide notice through the services or other reasonable means. Continued use after changes become effective means you accept the updated Terms.
